I have an outstanding account with Capitol One and have been receiving calls from First Source constantly and so have my relatives. Other companies have been very patient but they are extremely rude. They said "if you can pay other bills than you need to pay us". The other bills are my mortgage and car. They said "I need to insist my relatives help me out". I warned then to "cease and desist". They do not seem to understand what that means. I can guarantee, though, that they will be the LAST people paid becaue of this.

Any cease and desist must be done in writing. However it could result in them suing you quicker.

Markub, since you are behind your payments it is you who are on the back-foot, not them. Capital One has the full rights to pressurize you for the payments. I am sure that if you send the cease and desist letter, then they will sue you. Be cool and look for ways to pay them.
