Capital One threatening to sue after 60 days

Anyone dealing with Capital One in debt settlement at this time? They are threatening to sue after 60 days delinquent. I have tyold them i am being represented but capital one continues to call and send me notices each month.

Have you discussed the issue with the settlement company that you're working with? See if they can settle with Capital One with priority. You may also try to settle with Capital by yourself.
Frankly, it is the creditor's choice whether or not to work with a settlement company and FDCPA doesn't apply to original creditors. Hence, they can continue calling you and also can sue for the debt.
They are well within their rights to sue if you are even one day
They are well within their rights to sue if you are even one day late. Look at your state laws to see if they have any thing regarding behavior of creditors.
