Called Capital one.. no info on my account as of today

Okay.. Dunno anything about the legal system when it comes to this type of stuff. Ok, let's see.. So Weltman, Weinberg & Reis calls me today. I've been summoned to court saying they represent Capital One. I have an amount of $1,600 due (to them they say but then they tell me I can do a 36 month at $60/mo. payment plan ($2160.00)). I call Capital One a second ago and they refer me to some legal lady or whatever she was. She looks up my account and has no information on anything since Sept. 25 2008. They say that it it was charged off for $1007.32 on Sept. 25th 2008. I just need some straight forward advice on how I should handle this or what I could possibly do. I have signed nothing and made no verbal agreements. They say they're going to send me some kind of agreement paper in their words stating "I (me) own the debt and agree to make payment of x amount before x day of each month." I'm not signing anything or agreeing to pay anything until I can get an idea of where to go. (Sorry i've been unemployed for two years and I cannot afford a 150$ consultation with the lawyers around here)

If you have received a summons first thing you need to do is answer it to the court...then you need to show up in court. If this agreement will cancel out any court proceedings, you need to get that in writing too.
