has anyone ever been sued by this company? they have been calling and leaving the same pre recorded msgs for a few months, and i hae never recievd a letter? today they called my sister and said i needed to call someone there named rose and left an extension, by 8:00. and that they had court papers bearing my name and social security number....i know it is most likely reguarding an online payday loan...that is the only thing my sisters name and number would have been on for me....so most likely it is illegal....should i be worried?

As per the FDCPA, the creditor/CA need to send you a dunning letter within 5 days of initial communication before they start the process of debt collection. Since they have not sent you the same, they cannot collect the debt legally.
Now, since you have not yet received the summon, there is no need to worry. The CAs often threaten you with summons so that you pay off the debt.
