im having my check garnished from a judgment in georgia but i live in alabama there going thru a sister company we have in georgia can this happen if it hasnt been domesticated to alabama ? and i was never served and the SOL would be up according to alabama laws this judgement is over 7 years old


I would check into this. I don't think the SOL on debts applies if a judgment has been awarded on the debt. I recently read that judgment can keep being renewed.

I'm also not sure about you being in Alabama and judgment issued in Georgia. Did you live in Georgia previously? If the suit for judgment was filed in the county you lived in while in Georgia (if you in fact lived there) and was awarded, then maybe they can follow you to another state to get their money through garnishment. I would get a consultation with a lawyer in your area. There a number of lawyers who will give you a free consultation.

I've heard of this sort of thing before. If you're being paid by a Georgia company, they can garnish your wages there, even if you live in Alabama. Most judgments have an SOL of at least 10 years, generally, and are renewable. Find out which county and court in Georgia this judgment was awarded and request a copy. I don't know how long this has been for you, time might have run out for any action. If not, your best hope would be to request that this court in Georgia vacate the judgment due to improper service.
