We have reviewed the account belonging to debtfreein08. We believe all the terms and conditions of this loan have been met on our end, unfortunately debtfreein08 defaulted on her loan agreement and refused to repay her debt. Her account has been referred to an outside collection agency for handling. We no longer have any control over the account. We will consider this matter closed unless we hear from you. Thank you for your time and consideration in this matter. |
So, what do I do now? File an agreement against ARM-The outside collection agency?

Response
Good question. Their response to the BBB ended with the exact same wording as the above forum user's response. They consider this matter resolved until they hear back from the BBB. Only difference is they stated that they made me a reasonable offer. Next is going to be them turning it over to collections because I don't find their offer reasonable and I'm going to fight it. So what's up? They are now wanting almost $500 on a $300 loan. The BBB, to me, is actually no help. MTE just lies to them, then sends insane emails to me. What is the next step? Obviously the BBB is going to get us nowhere.

This is my first response from the BBB. I filed against ARM, too. Haven't heard anything from that yet. Should I file against ARM with the State of Florida?

I mean, what if ARM comes back and shows how they legally calculated the debt? I am so freaking out and worried!
Complaints
This was my first response from the BBB. They gave me until July 8th to respond to MTE response. I will respond - through the BBB. I will respond to MTE themselves - via email that they sent me wanting more money. So, once we "respond" to the BBB and they will then "relay" our message to MTE, then what? They're going to say it's un-resolved because we couldn't come to a mutual agreement. So is this a dead end???

This is what I said to the BBB:

This is not true. I have not refused to pay my debt with them, if they can legally show me how they calculated what I owe them and how they calcuated it, I would be more than happy to pay them what I owe. Also, I would appreciate it if you would not publish my cell phone number to them, as I have sent them a cease and desist letter not to contact me at my work or on my cell phone. Do I then need to file a compliant against the collections agency? As they are stating that I owe them money, but have not legally presented a letter to me showing how they validated the debt according to my rights under the fdcpa. Please advise. |
This is what the BBB said to that:
Quote:
I apologize for given them your cell phone number, but we are required to forward any and all information provided to us by the consumer. By using your cell phone number as a contact number, it was given to them. You may wish to file and additional complaint against the collection agency. That is your right. I will forward this information to them for their rebuttal response. |
You need to have the contract from MTE that proves them as legit
You need to have the contract from MTE that proves them as legit. It should have all the loan terms mentioned in your state laws and the collection fees when the account reaches in default. Any CA collecting on your account should be able to validate the debt with the following information. If there is no paper proof, you are not liable to pay anything. Just stick to your rights and demand documentation from the companies you are dealing with. Make sure that you do all the communication in writing through CMRRR. You need to have enough proof when disputing the charges with the pdl and the CA.

a neblat,
Thanks. From what I hear, ARM doesn't have a leg to stand on, because they can't legally prove the debt or documentation to show it. And, as I understand it, if they don't respond to my letter within 30 days, I do not have to pay it. Correct?

I will put in a better way. If I had been in your situation, I will not pay to someone who has not yet proven their authorization to collect on the account. Since ARM is not able to show any documents with the legal terms, I will not send them a dime.

Cannr, Do not I repeat Do Not get so upset about the BBB. In your state the BBB is not who you want. I got several e-mails from the BBB on MTE and they all were similar to this except mine was signed by Sabrina Collins. The internet ones are not legal there plain and simple. Even if they turn it over to collections they are going to be hanging thereselves also. The AG here is going after collection agencys that have tortured people on these payday loans. If they do that they are as responsbile as a payday company. They would be collecting on an illegal debt. Hope this helps. KYSIDE38

Oh, this is typical of MTE. How do they get that you owe them more money? Didn't you calculate that you owe them a smaller amount per your state laws? If so, then this is what you need to stick to. I would put that in your response to the BBB. I got to the point where I just filed with the BBB so the complaint would be on file against the company. I got the most response from the AG or DIF in my state. Also, they lied in their reply to the BBB as far as my complaint went. They even quoted some of the things I said on the forum. I had a different name them. Now, I am seeking other goverment help against this company. I'm tired of their lies and games. You are in the right here, just remember that. Try not to get upset over this. :)

This must be a day for the BBB...I also got a email from them with the response from MTE. Same thing...they believe they have met their obligation but are willing to let me just pay the principle of the original loan of $300....this after I have already given them $830. I also must respond by a certain date...however they also said they had sent me an email with the new terms which I have not recieved.

Like I said, they are just trying to cover their butts. I would not pay them another dime
mte response to bbb
Okay, I know I'm freaking out! And I know you guys keep telling me not to! I just feel like this is an unending cycle of lies that all agencies believe and we're stuck with paying a bunch of crap that isn't even legal. I'm replying to the BBB, just because I want them to reply back to MTE. Just for the harrassment of it all. However, I do believe, kyside, that I am going to concentrate on my AG more then the BBB. Now that I have more documentation (the emails stating MORE money, the returned mail correspondence, the lying and stating they are not the pdl's that they actually are, etc.)I am going to print off each and every thing and copy the returned correspondence envelopes stating they MOVED AND LEFT NO FORWARDING ADDRESS and also include my responses to my request of mailing addresses only to have them tell me to money gram them and not give an address. I've basically given up on the BBB. It's all AG for me. And also the Office of Financial Instituations. Hope they don't mind getting MORE correspondence from me; however, I feel as though they need to know the ongoing process that's just unreal. Do you think that's okay? To go ahead and "update" them on what's happened further. Because, to me, the further it gets, the more obvious they are using illegal tactics. Raising the amount due now? No mailing addresses? Money Gram or credit card payment only? Give me a break!

Well, okay. Here is what i got back from the BBB for my 2nd response:
We have reviewed the rebuttal forwarded to our company from debtfreein08. Again, all terms and conditions of this loan have been met on our end according to debtfreein08 loan contract, which she signed in agreement prior to receiving her loan. She should have a copy of it, which is proof of the calculations which she is seeking.
We are no longer at liberty to make any arrangements with debtfreein08 as her account has been referred to an outside collection agency for handling and we no longer have any control over the account. The Cease and Desist Order which she refers to is irrelevant at this point, as there is no reason that a representative of our company would attempt to contact her for any reason. We will consider this matter closed unless we hear from you.
Thank you for your time and consideration in this matter.
So, the BBB said this then to that:
The Better Business Bureau has received a rebuttal response from the business in the above complaint. Enclosed is the company's response to your second letter of complaint. The company has decided to stand by its original decision regarding your complaint.
In the judgment of the Better Business Bureau, the business has made a good faith effort to resolved the matter. Although we realize that you may still feel the matter is not resolved, We have closed the case.
What do I do now? I haven't heard anything from the BBB about the case I filed against the collection agency-Accounts Recievable Management of Florida. And, they have recived the debt validation letter, but havent' heard anything. can anyone give some helpful advice? I don't want this to follow me forever.
BBB
I've gotten one "dead end" response from the BBB so far. If we can't come to a decision, the BBB considers it "closed". I say, whatever. File again with your AG. I'm being serious. I'm filing again on my pdl's with the AG. I believe they need an update as to what's going on. The BBB tries to work it out between you and the company, but they can't force us to agree with each other. If you do not agree with MTE, do not mail a penny in. File again with the AG. And then sit back and let it ride. If they send you threatening stuff, keep copies, if they send you their calculations on how they came up with the amounts, keep copies. They're wrong. File again with the AG. File with your state AG and their state AG. It's not going to hurt anything.
File, File, File. Just because the BBB says it is closed, doesn
File, File, File. Just because the BBB says it is closed, doesn't mean it is CLOSED! You are not satisfied, go further, don't stop there! In their judgment it is fair for you to have to pay more money when in fact you have already paid TOO MUCH money? DUH, what planet are they from?

Well, I did file with my state DFI, and they did send letters and are investigating it. They haven't heard anything from the collection agency or MTE. So, we'll see. I did file with the FTC, but that didn't do anything.
no fear
Yes, nofear. You've helped. I'm filing again with the AG office on a couple of my pdl's, only because there's been communication between me & the pdl since I first filed. I am concentrating on the AG's office and the FTC now. I'm trying to not get so stressed out over this stuff, as you keep reassuring me the AG is working on it. I believe that. I'm also going to file with the AG office where the pdl's are. What the the heck. I've nothing to lose. Except the aggrevation of these pdl's! Thank you for your advice!

One done today. Boy, it's time consuming! But I filed AGAIN with all the agencies on one of my pdl's. Tomorrow I'll do one more. Over the weekend I'll do a couple more. By midweek, next week, I'll have them pretty much all filed again. Then, while I'm waiting for my "magical" responses (LOL) I think I'll email them all again. Gosh, I haven't gotten anything from MTE all day today. I'm beginning to miss them.........
