Credit card debt chasing me
Date: Sat, 06/23/2012 - 09:56
I stopped paying on a credit card over 4 years ago because the interested was more than the monthly payment. My actual debt on the card was about 2500 but after all of the fee's it went up to about 4500. Originally what happened was the credit card company changed by due date from the 28th of the month to the 22nd of the month without notifying me. I paid on the 27th of the month like I always did and they jacked up my interested rate to 29.9%. I called and they told me that they mailed out a letter and I had to respond to the letter in order to keep the same due date. They would not work with me on lowering the interest rate I just received a phone call from a person saying that they were with the court and they had to deliver some papers. I asked what for he said "let me open it and see, he gave the name of the New debt owner and gave the amount owed". He told me that he was at my apartments waiting for me. I then denied it was even me and told him that he had the wrong number and hung up. Here are my questions.
1. If he was sent from the court house then he couldn't open the papers or wouldn't know any info about it, he would just serve me the papers, Correct??
2. What would do I do when I contact the company who owns my debt? What do I ask for? Proof of debt, proof of the last known activity, etc?? what else?
3. Its been over 4 or 5 years since ive paid on the card or had any correspondence with debt holders. Is there a statue of limitations in the state of Texas?

1. You are correct. A process server won't call you on the phone
1. You are correct. A process server won't call you on the phone if you are not home or contact you beforehand. A process server won't open an envelope meant for you.
2. When you contact the collectors, you ask them to validate the debt and once they have validated it, you try and settle if possible or work out a payment plan.
3. The SoL in TX is 4 years for this type of account. When exactly was the last date of activity against this account?
