ok Q's
1. can a Creditor and a DC report the same debit and not be in violation?
I know the original creditor can but can they double dip the ding?


2. If the DC reports the Original debt as a Zombie what violation?
I they create a new date, etc.

If your account has been charged off and sent to a collector then the account would appear twice both as charged off and in collection. It's not a violation.

I'm, however, not sure about your second question. You may need to frame it in a better way. Anyway, if the debt is an old one but the debt collector is still reporting it in your report, you may wish to dispute it with the credit bureaus and also send a validation letter to the collector.

The original creditor having charged off the account may still own the right to collect (having not sold the debt to a buyer) and will still report a balance owed to the CRA's.
If the original creditor charge off the debt and sold the account and the buyer/collection agency is now reporting the debt to the CRA's with a balance owed AND the original creditor is showing a balance owed- That is the violation. You are getting the double ding on the amount owed.
There are other examples of duplicate reporting that can be removed through a dispute.

If the original creditor is not reporting a balance owed and the collector is, that is pretty much how it can work. Sucks, but....
