What are the chances for a settlement??

I am seeking so advise so that I can pass it on to my mom.
She signed up with Acheive Financial to help settle her credit card debt. A couple of months ago she was sued by three of her creditors. They used the same Law Firm in our State. Based on advise from Acheive, she did not answer the summons or attend the court hearings (mistake on her part). They of course, received a default judgment and have since began garnishing her wages and have withdrawn funds from her checking account.
I have tried to encourage her to talk with the law firm herself about setteling these accounts, however, she believes that Acheive is trying to negotiate on her behalf (which I do not believe).
What are the chances that she will actually get them to settle for less than the judgement amount since there is already a default judgement in place and they are already garnishing her wages. Any advise would be greatly appreciated. Thank you.


I can only speak from personal experience, but I doubt very much that she will get them to settle for anything at this point. Since they have already been awarded judgments and the garnishment and attachment to her bank account are in effect, they probably won't even respond to communications.

Have you checked out Achieve Financial with the BBB or a state agency to find out if they're reputable, satisfactory record, etc.?

The only way I know to get the garnishment and attachment to your mom's bank account stopped, is to file for bankruptcy. She would be better off seeking advice from an attorney in your state to see if there is anything else besides bankruptcy that can be done, rather than relying on Achieve Financial.

I appreciate your advise. I was afraid of that. I have not checked out Achieve Financial with the BBB yet. I am trying to convince her to contact the attorney's herself about paying these off but she is insistant that Achieve is working on her behalf, which I really do not believe. Plus, I do not think at this point they are going to communicate with Acheive regarding a settlement. Sigh, wish I could do more to help her.

I can understand. These companies convince you that they are there to help the consumer get out of debt and are working for them, etc. A load of crap! I have been screwed twice by debt settlement companies and debt consolidation was a joke in my situation, so I think you are right in the advice you've given your mother. She definitely need to contact an attorney. Not necessarily the attorneys that have sued her, but one that is objective and can advise her as to how to handle this.

I agree that the attorneys who have sued your mother are not going to deal with Achieve. The same thing happened to me as far as that goes. I got sued for a judgment, and because the debt settlement company I was using had sent a limited power of attorney that I signed as well as a change of address form to the creditor's counsel that was suing me, it really made them go after me even more. They don't want to deal with anyone other than the debtor or an attorney representing the debtor at this stage in the game.

I just checked out Achieve Financial with the BBB. They do have a satisfactory record, but have had complaints. 14 within the last 12 months. They did respond to the complaints, though. The company I was using had a decent record with the BBB in the beginning, but when I realized that they were doing nothing for me and decided to check them out again, they had developed an unsatisfactory record, and complaints were pouring in.

So, if you don't feel that Achieve Financial are doing any good at this point, please continue to try and get your mother to contact an attorney to help her. Also, she may be entitled to some of the fees she paid Achieve to be refunded to her.

Thank you for the information. I am going to continue to encourage my mom to seek advise from an attorney. At this point I think the only thing she can do is pay them off but my problem is convincing her that Acheive is NOT going to be able to work with these guys.
