The notice was NOT certified, did not have a raised seal from the state she did NOT have to sign for it and the form looked like anyone could have typed it up. She ignored it and nothing further happened.
This past October, after only ONE attempt to collect a debt from me for $2,000.00 my Wife received a knock at our door with a person just handing over papers to her. The woman never said who she was with, asked who my Wife was and she just stated her name and the woman left.
The notice was for me to appear in court on (said date). Again, not certified my Wife DID NOT sign for it, no raised seal from the state and was the same typeface that anyone could have made.
I panicked! I called the lawyer in charge of this account without knowing what my Sister did with her notice and worked out a payment deal with the lawyer. They agreed to $50.00 a month for a year and after that it would increase to an unspecified amount.
Since then, I have been paying $50.00 to this lawyer with the impression that $50.00 is going to my credit card company. It is not. The lawyer is ‘pocketing’ MY check and sending a lower amount to the creditor.
I signed this agreement under false pretenses and now I wish to back out! Can I? The letter was not certified, no raised seal, I nor my Wife had to sign for it and he is stealing from me. Plus I can no longer afford to send $50.00 a month especially if he is going to continue his practice of duping me and stealing from me.
I want to stop paying him. Is it legal to do so, considering everything they did was not!?

It is called collection fees or attorney fees. The lawyer you are dealing with is not a debt consolidation lawyer...he is defending the plantiff, the credit card company.

"Plaintiff hereby withdraws its Motion for Judgment on the Pleadings..."
Does that mean it is no longer valid? Do I still need a lawyer to fight this or can I simply just not pay anymore? I can't afford a lawyer no matter WHAT the cost!

After I foolishly agreed to a payment plan with this lawyer, I received a letter from him that states, "The Plaintiff hereby withdraws its Motion for Judgment in (said case)."
Does this mean that there is no longer a judgement against me and can I stop paying it? I cannot afford the $50.00 a month that I am paying him and I CERTAINALL cannot afford a lawyer either.

Double check with the courts on that one. How did you get a judgment anyway, did you fight it? If you are *that* insolvent, I can only think that you didn't present a proper defense but it seems to me you settled (and why would you settle for something you can't afford?).
