I live in Atlanta, GA and hired E. Francisco and Assoc./Debt Reduction Law Center to modify my mortgage. Can I sue this firm ? They are located in California. They told me to stop paying my mortgage and not to worry about it because once they modified the loan the $ owed would be wrapped up into the modification and I would still have a lower monthly payment. I tried dealing with the bank directly but they refused to listen to anything I said. This firm did not have any more success in getting through to my bank than I did myself. They eventually failed to get the modification and left me in a much worse situation. On top of that, they stopped taking my calls! They just left me hanging,,,ALONE... Now I am trying to short-sell my house but may face a HUGE deficiency judgment. Please advise.


Unfortunately, Debt Settlement / Reduction companies are known to be circuitous with their client. You may see their move as unethical but they certainly do not. Many people are suck into easy sales pitch by debt reduction organization. You may of have already give up all your right to sue with their initial retainer agreement. These agreements typically are one sided, with non responsibility clause.

There may be high probability that creditor (Bank) may not sue you for deficiency judgment as most homeowners are up side down in their loans. Nothing is guarantee. If they notice you conceal asset than possibility of law suit exist. Perhaps, you should check local state law if deficiency judgment is allowed. I know states like Arizona, possibility exist.

Have you talked to your bank to find out there is any possibility of absolve exist on past due amount ?
