How can I remove this debt from credit without paying it?

My car was towed. I called the tow company the next day. I told them to keep and sell the car, I didnt want it. I asked them, "will I be charged anything?" They responded, "You will not be charged for anything else"

One year and 6 months later I check my credit report an I have a defaulted account with said towing service for $1.3k. To this day, I have NEVER recieved one peice of documentation or phone call from any organization about this. I was blown away.

I called the towing service and requested information. The lady I spoke with told me that the charge was for housing fees from the time it was towed, till the time it was sold. She said that the ammount the car sold for was subtracted from the debt. I explained that I was expressly told that I would not be charged anything. She said that was impossible because that individual would recieve commision on the sale of the car. I have no idea how that makes anything impossible, if anything it makes it even more likely that I would be lied to.

Regardless, I refuse to pay this charge, and I want it stricken from my credit report. Its not a large sum, but its more the principal of the thing. Im just trying to find out what my options are. I talked to a consultant at my bank and he told me to file disputes with all 3 of the credit reporting agencies, and that if they could not verify that the information was correct within a month that by law they had to remove the charge from my report.

I would like to find out if this is correct.

ANY help would be VERY appreciated. Thank you for your time.

Anyway, Im seriously considering filing a credit report error with the FTC, to see if I can get it removed. However, since they Never sent me anything except for the title transfer paperwork I have NO documentation to support my credit error report. Do you think this will be a problem?

Also, on my actual report, this account is closed with Experian, but open with TransUnion, and Equifax doesnt even have it listed.

How long did they have the car before you signed it over to them?

I would dispute it with the CRA's and see what happens there. Then if that doesn't drop it off of your CR then I would write a letter to the towing company. Because I believe (someone correct me if I am wrong) that as soon as you signed the title over to them then the car became their responsibility, for storage and whatever not your because you no longer owned the car. But up until you did that then you would be responsible to pay that portion.

This is how it works in places I've lived [TX, OK, WY]. Ownership of a vehicle is determined by title. Once you sign a title over to another party, they own that vehicle [in the absence of a lien, of course]. If you sign the title over to the towing company, mechanic, or whatever, it becomes their vehicle at that moment. Sounds to me as though they're trying to charge the OP a bogus storage chjarge on a vehicl that wasn't his.

I have never dealt with this before but did the date on title transfer paperwork coincide with time frame or much later after the car was towed? I have a friend of a friend who is very prosperous in the towing business..he sells impounded vehicles to another company for $100-$500..the person resells vehicle for actual retail value $800-$2000 and then under the table splits profits with towing company..says it is quite common in this industry..so if this happened in your case you got stuck with a huge tow bill..amount of what was deducted from bill wasn't anywhere near what the vehicle was worth..and now a storage fee is involved. Also I always thought a certified letter had to be sent to last known address before anything was sold out of storage? Also can you get documentation of person they say vehicle was sold to and when? Please follow up on what happens to you in this case bewildered..there are so many stories here about how people get hosed because they expected the other person to do what is right.. it really stinks..good luck to you!
