Dell Account-Statute of limitations

Charge off-November 2008

Total charge off amount-$2500

Paid towards balance-$1000 via FRS (collection agency)

I offered a final payment of $125, to clear the account! FRS sent the account back to ARS-Dell’s (in house collections department). I called ARS, offered another $125, they “said no” (such a shock). ARS offered $780! One final payment or extended to 90-days, and the payments broken up for 3-months.

My question is should take offer? Or just ride the storm? I know Dell is famous for taking folks to court! My last payment with FRS, just in August-2012?

Suggestions? Advice?


@Barbara - you are right it looks like there has been a change for PA, contract used to be 6 it did state:
The statute of limitations on debt in Pennsylvania limits the time you can be sued for a debt.

Oral Contract: 4 years

Written Contract: 4 years

Promissory Note: 4 years

Open-Ended Accounts: 4 years

by paying on the account you did reset the SOL.so try and work out the settlement and get it in writing.btw chargeoff doesn't mean the same as date of last payment/first delinquency.totally different.
