Getting called for ex-wife's debt.

He recently received calls from a collection company pertaining to a medical bill with his ex-wife's name and address (that she lived @ after he kicked her out) for some OBGYN services.
He sent the company a copy of the divorce judgements that state that the debt with his ex's name on it belongs to her and he provided them with her address - but they refuse to take the debt off his credit report and are trying to force him to pay it. Isn't the judgement enough to force them to leave him alone?

Divorce decrees are not enforeable...the creditor is under no obligation to take his name off anything including removing it from his credit report. He still owes it. To enforce that decree, he would have to haul her back into family court and let the judge deal with her.

well, this one may be easier to handle than that, because its a medical bill. Your boyfriend needs to send the debt collector a certified letter disputing the debt and requesting validation. When they cannot provide anything anywhere with his signature on it showing that he agreed to accept responsibility for the bill in any way, that should tell them something. Whenever you go to the doctor, you sign a consent form that basically says you agree to pay for all services rendered. If his name is not on that paper, then he is not responsible for the debt, plain and simple. The one and only exception is if you live in a community property state, and if the bill occurred while they were still married. In that case, they can legally come after him for payment. But, if you live in a community property state he can still go to family court as soaplady said.
