if you were never served with a summons for the court case, then
if you were never served with a summons for the court case, then they illegally obtained this judgment in the first place. Was the case heard in the court in your county of residence? If not, then they did that illegally too.
I would consult with an attorney and ask about filing motion to vacate judgment due to improper service. Its possible that you may be able to get this whole thing wiped completely out altogether.

Thank you all, I am going to be discussing this with an attorney. They never sent me a summons, they submitted the lawsuit in Los Angeles County Beverly Hills court and i live in San Bernardino county. The other thing is that nothng regarding this debt appears on my credit report, not even the judgement, I am getting very worried, espeically becasue I was just served a disconnection notice from Edison, this garnishment is wreaking havoc...

OK, now this is important--did you ever live in LA County? If you lived there at the time that this debt originated, then they can sue you there. But more likely with LVNV, they probably tried to sneak a judgment past you by filing in a county you dont live in so you wouldnt hear about it in time to contest it. This is a common trick that these low-life companies like to use to illegally get judgments that they are not entitled to get. Think about it--if they had sufficient evidence to prove their case, they wouldnt have to sneak around the law and file lawsuits like this. If you need help with trying to have this dismissed, I can also help you prepare motions and so on. But my first recommendation, if you have the means, is to speak with an attorney. If you cannot afford to hire an attorney, there may be a legal aid office that helps people who cannot afford attorney's fees. Check in your county to see if there's one there.

Thank you Skydivr. I did not live in LA County at the time of the judgement, in fact, the were sending all of the documents to an address i did not live at for over 7 years. I was looking at California court forms and unfortunately i cannot afford an attorney as the garnishment has sapped my income for the month. I am trying to have this dismissed and am open to your assistance.
