Hi. I have been sued by Midland Funding for FCNB, Asset Acceptance for HSBC, and Capital One in the past three months. I was able to pay the settlement amounts for each. Wiped my savings out completely. This week my ex-husband got a letter at my address from Midland Funding regarding his defaulted FCNB account. We were married when he had the account, but I was not on the account. I did not sign anything and was not an authorized user. Can they come after me if he does not pay? We live in KY.


There are few state that are considered "community property states" where a spouse is liable whether or not they actually signed the agreement.

Lucky for you, Kentucky is not one of those states. You would have needed to be on the account for them to come after you - if your husband applied and obtained that account on his own, then you are safe.
