Small loan cap in NY is 25% - here is what I've paid against what I borrowed. (My payments are shown with a negative because of how I built my spreadsheet)
Can someone help me figure out my balances?

Are some of these internet payday loans? If so, although some here will put me over the fire for this advice, but if some of these are not licensed to operate or collect in your state, I would tell them to Fuk off, because they have broken the law, and attempted to victimize you monetarily. Immoral? Yes. Legal? yes. You decide.

Thanks for the help on the calculations. Yes- all of them are internet loans. I have mixed emotions on all this but it is my intent to pay what NY state would say is legal for small loans (25%) I honestly did not know these type loans were illegal in NY. I used them and knowingly signed contracts but I was desperate and as time went I became entrapped where I had to keep rolling over to keep up. My account is closed, my first default will be this Thursday. I plan on phoning, faxing and mailing (where I can) all letters to the PDL's and also filing with the AG, Secret Service and so on before Thursday comes. I am also going to provide my loan history back through 2005. I had paid off numerous loans with some of these companies and while I don't expect refunds from the closed loans I want to provide the AG with all of the history to help my cased and provide evidence to help the future. Moneyline has closed mine paid in full already. When I saw how much I had paid them I called and they agreed without a question. They don't know I'm coming back for a refund but one thing at a time.

My heart is breaking. They have taken soooo much money from you. And, I too, agree with Anthony. They can go straight to hell. You've paid them soooo much over the required amount. I know you feel responsible for repayment and that you signed the agreements, but, honey, look at your spreadsheet! You've paid these people the equivalent of a friggin car! Please don't let them take any more money from you. Please file complaints with EVERY agency you can dream up. You've basically been raped.

When I sat with the bank rep on Friday as I was closing my account she printed out all my statements back thru 2005. She actually got tears in her eyes which of course got me crying - she basically said the same thing you have. I've thought a lot about it over the weekend the ones that were companies I have used for years are going to be approached with applying my over payments from previous loans to settle the current ones. I'll keep you posted.

MPEREZ< I can tell you dont give them another dime. You have paid thru your teeth at the least. The NY AG is hot against these kind of loans. I would bet 99.9999 percent chance they are going to tell you not to pay anymore. They are PROHIBITED there. They should have never loaned you the money the contract is null and void plain and simple. KYSIDE38

I am going to wait it out - the ones where I owe are offset with ones that are the same company but under another name where they owe me. Plus I have been in this trap for years - If the AG is able to access my previous loans I'm sure they will settle if not refund me something. I hope anyway. I'm really getting nervous but I'm taking a deep breath and jumping in - I want my life back even if it has to get ugly for a while.

Is what you are all saying here is that since internet pdl's are illegal in New York, then actually your contract isn't worth wiping your butt with? Please clarify for me and for mperez, I'm sure. It sounds as though you're saying that since internet pdl's are illegal in New York, they are obviously not licensed in New York, that the electronically signed internet contracts are un-enforceable? Just basically that you're actually not legally bound to pay them? Just morally? Since the internet pdl should not have been funding loans in New York state in the first place?

Thank you, kyside! To the rescue once again! I really hate to sound like I'm "thick", but I just wanted to make sure I'm understanding this. Since it is so logical, you'd think a person wouldn't get confused. However, a state does not allow internet pdl's, a pdl gives you funds via internet contract, you "default", over pay, don't pay, whatever, then the pdl comes after you with shooting guns spouting off "laws" of their state and scaring the living crap out of you. And also calling and harrassing and sending 100 emails. When, in fact, they are breaking every law in the book by lending in unlicensed states, using threats to make people pay, and also continuing to debit bank accounts into the $1,000's of dollars. Okay. The more clear this becomes, the madder I get. I'm about ready to file more complaints. This time on the couple that I hadn't filed anything as of yet because I was confused as to how to handle them. They are spouting THEIR state laws. I have told them internet loans are illegal in my state. They still stand saying their laws are enforceable and the contract is legal. What the??? No, apparently it is not. Is this a scare tactic? They are saying the contract is upheld in Delaware and the transactions take place in Delaware, so it's legal. Ummm....I'm not in Delaware. Is this worth filing a complaint? I haven't done so yet, but now I''m kind of getting ticked off!

My advice would be to file every complaint you can file on all of them. Dont leave a single one out because they are all scum. KYSIDE38
