My husband and myself have about 40k in credit card debt.My husband lost is job 13 months ago.He is on unemployment and was forced into early retirement due to his age (63) unable to find a job.We do have a savings acct.but in order to keep up with th bills we had to start using our savings. We have been making monthly payments on our credit cards( minimum) we are thinking about bankruptcy if that is our last option. My concern is that i have a medical malpractice law suit pending (I am the administratrix of the estate) Can the creditors put a lien on the amount owed to them?And if we were to file chapter 7 what does it mean that the court could have a trustee??


There really is nothing wrong with bankrtupcy...it gives you a fresh start and allows you to start living again with a clean slate. Make an appointment with a bk attorney. The medical malpractice...if that is being used for future medical might have special conditions in a bankruptcy. Talk to an attorney.
