Can they garnish your paycheck? It depends on which state you reside in. Can they collect the whole amount? Definitely not. They can take 25% of your disposable income or "x" amount of dollars based on what you make per month. It's difficult to tell you whether or not they can garnish your paycheck with the information you provided.
I've definitely heard of asset acceptance, and I'm surprised they are not budging. Based on what you're telling me so far, it doesn't seem like they violated any laws just yet.
You mentioned you got a summons, did you file an answer for it? If not, do it quick before you get a default judgment.

In the paper work they didn't say to appear directly which really threw me. I also set up a payment plan with said annoyance. The catch, I called the courts last week and they said, that I needed to notify them of a payment plan. My first thought is, really? come on now. The company themselves didn't tell me ahead of time that I needed to notify the courts of the payment plan. So that leaves me asking, what's the next step since they're not making much sense?

Did you answer the summons to the court? From what you write, it sounds like they already got the judgment against you. It is your responsiblity to answer the court and then check the dockets for the court date....the CA/law firm is not going to instruct you on civil procedure.

The catch: I was never given a court date. They just said I failed to appear and didn't say anything further.

You say you were not "given" a court date...did you check the court dockets for your court date? Call the courts? Nobody is going to "give" it to you....you need to find out when it is.

I did check the dockets for a court date, they gave me the run around when i called. All of the documents that i have in possession don't give me a court date or presiding Judge.
