We are just past the one yr mark since last payment. The account has now been sent to Frederick Hanna. I'm sure he will sue since we now reside in Ga. I am sending DV letter Tuesday. Wondering how I can find out if Capital One actually sold my account? My balance is around $3100.00. A friend will loan me around $1500. Has anyone made any recent settlements with Capital One? Would I be better to try and settle with the lawyer despite hearing how ugly they are to work with.

They haven't called us yet. I am reluctant to call them and acknowledge the debt because I can't settle for more than $1500. If they sue, I have a feeling they won't be able to provide proof. I really don't anticipate them accepting settlement. Am I just increasing my chances that they will win a judgement if I speak with them and can't reach an agreement? I would love to pay them but due to job loss the funds aren't there. We really can't afford a garnishment either.


You can contact with Capital one and get information from them regarding your account. If they have sold your account to that collection agency, then you can contact with them. You can make a written request to them for a debt validation letter via certified mail with a return receipt request. If they send you a proper debt validation letter, then you can negotiate with them. You may arrange a better repayment plan with them. If the collection agency doesn???t agree to negotiate with you, then you may get help from a debt relief company. This company then negotiates with the collection agency on your behalf. Otherwise, if the collection agency doesn???t reply, then you can forward them a C&D letter.
