First of all, thanks for having this forum available. I have one storefront payday loan in texas (Ace Cash Express)in the amount of $400 that I pay *85 dollars every 2 weeks on, and a $500 internet payday loan (PayDayMax) that I applied for my first extension with for this weekend. I had been involved in payday loanss and the viscious circle a few years ago when going through a divorce and I was just desperate. I swore I would never go through them again, however, desperate times and all...anyway, I ended up paying my last payday loans off back then, Ace Cash Express I had to borrow money when they called me and told me that they had been working through the Sheriff's department in the county in which I reside, they had me located, and I would be arrested at my home if I didn't pay by 11:00 AM of that day. Of course, I had to borrow the money from a friend, I was really embarrassed, especially afterward when I found out this was a scare tactic. The other one a few years ago, I paid through a payment plan set up. My question is now, how do you go about freezing your account. I've been in contact with my bank and I'm getting ready to go down and handle this, however, I'm not sure if these payday loans come out in the form of the voided check that I had to give to get the process started, and therefore, constitute an actual check, or if they come out as an automatic debit. I'm asking because I'm not certain if I need to freeze my entire account, or just freeze all automatic debits. I would like to close my bank account and just start over, however, I will have a very few checks that have not cleared my bank yet, so I'm holding the account open until they come through. It's getting down to the wire with this first extension due to come out tomorrow evening and I want to handle things before that shows up at my bank. Thank so much in advance.


You know the name of the storefront lender whom you fear doing the debit in your checking account. They have a payer code with the bank through which they do all the debits. If you ask your bank to block the transaction code of the company, the storefront lender won't be able to do any kind of debit even by using different amounts.

Have you reviewed your statements and verified with your state laws to confirm if you owe anyone? If you have paid the amount your state allows, you are not required to pay more than that amount. The company will persuade you to keep paying but you have to stop and you can do that only when you have paid what your state allows.

Almost every storefront loan company follows the laws in their state. In most cases, the internet lenders violate the laws. So, if you do something, make sure that you have paid the loan in full. If they are able to prove that you didn't pay them full amount and tried other means to escape the debt, they won't leave any chance to sue you.
