Hello again. I was having a problem with one person...now I have to deal with another bill I brought on myself.

Fireside Bank is working on garnishing my check. I currently have an attorney to work with me on this, but heard of banks that gouge people on car loans?

I don't have a problem with paying these people, but I need to survive and what they are asking for is unrealistic for me. I also feel that when I go to court, they will not look at my side fairly. I am very frightened about this.

Any information would be helpful.

The bank will force on everything so that they can get their money back. But for this, they can't take the blood out of you. You will pay only what you can afford and the judge is there to take this decision. He will frame your payment arrangements. Remember, if someone doesn't have a job at a certain time, the judge doesn't garnish his wages. First, he gets a job, and then he makes himself steady at work and should have his income more than the minimum wage requirement. A creditor won't be interested in garnishing your wages if you don't have the following

A vehicle
A regular wage
Bank accounts
Real estate (other than your home)
Investments such as stocks and bonds

Keep the copies of the payment plan you proposed to the company. Though the company may not have accepted it yet, but the judge will evaluate your income and expenses and figure out that the proposals you offered is realistic. So, the judge will take your favor.

also do not give them any info on where you bank because these companies can take money out of your bank account depending on the state law on how much they can take...also if the judgement was take less than one year ago you can file a motion with the court to reopen the case and jsut disput that you dont feel you owe the balance they recieved a judgement on...also then ask for copies of documents and payment histories...then if they get all that tell them you want a stipulation of judgement where you make suitable payments on a monthly basis...if that doesnt work ask them to do a consent judgement on the file where the company still gets there judgement but they wont garnish your wages and you make a voluntary monthly payment...u can file an answer to a garnishment with the court and set up a court date to go in front of the judge....hope it helps...ive been a paralegal at a collection law firm for 6 years and am now opening up my own buisness doing consulting on everything from helping repair credit and settle debts...any questions let me know

Hello again: I have another question: I was able to obtain a laywer to help me, but when I went to see him this week, he told me that at this point, I am at their mercy. I just got my check today and its $600 short, which means I could only pay for my rent and food! This is not fair. I emailed this laywer again and asked him if there is anything else that could be done so I can have some kind of favor in this. Of course, its a network lawyer through my benefits and I think as long as he gets a check, he just wants to get this over with and move on. HELP!!!!!!!

They filed everything with the court and with their attorneys. I know I owe, so I didn't contest it. When the judgement came down, I tried to work something out with them, but they want it their way, so I got a garnishment notice. I have an attorney, but he's just telling me to "bow down" basically. Is this right?

Discover card is garnishing my wages. They say I owe $5800.00 but my credit limit was only $3500.00. THis seems unfair, also the 30% allowed to be garnished is too much, I won't be able to survive and pay my other bills because of them. Is there anything I can do to lower the amount, my court date is June 24, but my employer will be starting the garnishment on June 15, what to do. Is there any loop holes I'm missing.
