Can credit card companies garnish wages in Georgia?

Check the last payment date on your account. Every state has its own statutes within which the company can take legal actions against the consumer. Once the debt is past the SOL, they lose all their chances to win the legal case against you.

In the State of Georgia can a creditor of an unsecured debt garnish Social Security benefits and/or a State pension as relief for the debt?

Only federal debts like student loans and IRS can garnish SSI.

PA is a no-garnishment state.so no they can't.

A collection has filed to put a judgement on my husbands wages 3 months ago and so far they have not taken anything from his pay. I called and asked if we could pay it off (we were already making payments) and they said one they sent it in there is nothing they can do...any idea why they haven't taken it out of his paycheck..thanks

You can pay off a debt in full any time, even if a garnishment order is in effect. Call the court to find out the balance.

It's sad to say, but yes a credit card company will get their money. Here is what happens. The crdedit card company sells the account to a law firm in the state that you are in which in my case I'm in GA. The law firms goes through the procedures to start the garnishment and once they start, I can tell you that they don't want to budge when you ask for a settlement. Im having to experience things the hard way.

i noticed you never mentioned court or going to court meaning the law firm doesn't need a court order to garnish.so unless i miss my guess you are implying that a garnishment is just a formality.that is true if said law firm either serves improperly or not at all.also,alot of states have "head of household" exemptions,and while you are in GA a few states are non-garnishment.like TX,and PA.last but not least.unemployment,and SSI or disability are exempt income from garnishment.bottom line your ramble had more holes than a spaghetti strainer,and needed to be answered.
