Attempting to negiotiate wage garnishment amount
Date: Mon, 07/06/2009 - 06:47
I recently got served with a wage garnishment due to a medical bill. I was doing some research about ways to fight it, and saw that some attorneys will negiotiate the garnishment amount to something you can afford. It said to always get it in writing. What do you think of this letter? I was going to send it certified mail today. If they turn it down, I will file a motion to stay and use this as proof that I tried to negiotiae first:
I basically say in the letter why I can't afford it (other medical bills, pending surgery, groceries etc. I even put something in there about PDLs) and say I can afford to do $25-$35 a week as opposed to the state max of 25% of each check. Do you think it will be successful?
The reason I didn't cut and paste the letter is because it kept saying I had a bad word in it...even though I didn't

I don't think that the creditor will agree to a $25 - $35 paymen
I don't think that the creditor will agree to a $25 - $35 payments if they have judgment against you to garnish 25% from your pay check directly. However, you can contact your creditor and try to negotiate with them.
