Welcome to the Forums :D I am sorry to hear about your husband.
Welcome to the Forums :D I am sorry to hear about your husband. If the loan is in his name and not yours, I would try to get the funds out of your joint account. They will often continue to debit your account over and over. Are you able to change that, or do you have to wait until probate to do anything about this? If you have any questions, please ask, maybe we can direct you to a solution. Keep us posted...Karen

well they were taking the moeny from our joint account. I have absolutely no funds. I can't pay them. we had no life insurance or anything. I am left with nothing. Should I just close my bank account and contact these loan places again. Or give up and start over on my own.

This may be applicable on payday loans also, but for other types of debts, some "community property" states like Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, or Wisconsin require the spouse to pay the debts of the deceased. If you are living in the other states, you aren't responsible for the debts.

Be careful if the lender is a storefront. They will file a case in the court at the slightest hint that you are not willing to pay your husband's debts. Talk in advance if some arrangements are possible. This may not sound good to you but ultimately you don't want to stand in the court and hear something unexpected.

I live in Michigan and the loans were internet loans. NOT storefront. I have emailed, called, and faxed these places with no help. One is 500fastcash and the other is Paydayok. The loans were each $300. so small amounts but still we have paid a lot on them and still owe the original loan amounts. I did call my bank and had the joint checking closed. so if they try to get money out of their they won't get it. But I still don't want to screw these companies either. I just want some help. Thanks everyone.

The original amount should be paid off by now if you have sent them too much. The Michigan State laws are explained here. Review your bank statement and confirm it with your state laws. Then, draft letters to the companies reciting your state laws and insist the account marked closed.

Can you contact your bank to dispute the debit? This way the funds my get back into your account since it seems that you have overpaid on these loans. The loan originates in your state so the lender must follow your state laws since it's internet based and not store front. I would also send them a certified letter with return receipt stating your laws if you have overpaid them. Good luck to you and I'm very sorry to hear about your husband. You have come to the right place for this type of advice.

payday loans
Welcome to the forums. You are dealing with two affiliates of Rio Resources. They are one of the dirtiest payday companies out there. I would contact Attorney General in your state and tell them your husband is deceased and they are ripping you off. I think they will be able to do something. Rio Resouces is under investigation in many states and also by the FBI. They are a dangerous company and need to be closed down. This is a difficult matter and you need help. The Attorney General is free and can direct you in the right place. Good Luck So Sorry for your Loss. KYSIDE38
