I'm about to start dancing with my unsecured creditors, five credit cards totaling $85k.

I've got a decent story behind my financial hardship, but am still employeed and earn a "decent" salary. Despite the salary, still can't pay the creditors though... But worried that they'll fight me on settlement if they know what I make.

Wondering if they do any kind of employment or income verfication? Not planning to mislead them regarding my income, but also not planning to discuss it either. Will this affect my ability to settle?

Most, if not all, of my credit cards date back several years and employers ago. So unless they are getting information from other sources, not sure how they'd verify my current employer or current income.

Any thoughts? Experiences?


Some will ask, some won't. Out of 6 I never had anyone verify. However, look into your state garnishment laws. Although I make a lot of money my wages can't be garnished so it doesnt matter to them. They settled with me b/c I have no assets and only assets were what they could get in my state due to not having the ability to garnish.

im not sure of wage information. I do know though that i went through a debt settlement company that i had to show my income and financial hardship story. I dont believe though that they ever gave that information out about my financials only that i had more going out than comming in and that i would have to file bankruptcy soon if they did not comply. are you planning to debt settle yourself?

Yes, the plan is to settle on my own. We've discussed our situation with a couple of companies that settle unsecured debt. While enticing to let someone else handle the problem, 15% of the total debt is a fairly sizable fee for something I can probably handle myself (or I hope I can).

The settlement companies never asked our income, but we just had informal conversations with them. I've also spoken to an attorney who is a bit more of a bankruptcy advocate, and a friend of a friend, who indicated that my salary is too much to declare bankruptcy... even if I can't afford all of our payments.

Anyway, I appreciate the responses so far. Still interested to hear more, if anyone has anything to share.
