I received a vm at 9:16 AM this morning from a man named Brian Lockwood stating that he is a independent process server and he received a fax in his office for a summons or actually a re-issuance of a summons for my husband...says its a code 40-hot check issuance...my husband NEVER writes checks nor do I...he gave my husband's dob and states he was hoping to speak with him directly so they could meet so he could serve him the documents...he also says he will be out in the field trying to serve the documents to him at his place of employment...he states my husbands former employer but not the address and then says if he can't serve him there he will serve him at our home. He then proceeds to say that if my husband has any questions my husband would need to contact ARD Firm @ 888-240-5810 and he gives a document # to give to ADR Firm...from what I read on this form from 2011 this is a scam...We live in Texas and I'm wondering who can I contact besides this firm to see if there really is a summons for my husband?

first report this idiot and ADR to your AG asap.you check with your court clerk as you must be sued in your town, county, village,or bourough.however i guarantee there is nothing.why?a few things from this idiots call.

1)hot checks as he calls them are a crime, and ADR collects for illegal internet loans.
2)real process servers never call in advance,or give you any info themselves as they rely on the element of suprise.

so this idiot is using illegal threats and scare tactics.check with your court clerk, and when it's confirmed there is nothing.again report this idiot and ADR to your AG,and your police as he broke the law in alot of ways with that call.just know that.

paulmergel is 100% correct. Check with your court, no real process server would announce his coming. However, I would use the situation to toy him. Next time they call, tell him you can't take them seriously after they promised to serve you but never did. Ask him if he's man enough to serve you, if he didn't serve because he's scared. This will have the effect of calling his bluff, and in the highly unlikely event that they do serve you, you've got their ass on a silver platter and should have little trouble defeating them.

sorry, but i don't recommend that options.scams like this and the bolier room scam in INDIA are delusional.the more you talk to them.the more they call.a couple of points here.

1)the loser had old info.meaning the illegal lender gave whatever info they have.

2)again as stated no real process server will call ahead.also they can't really serve at one's work.to state he would try there first is a dead giveaway.

sorry, but once the OP finds out there is nothing as far as an action against them goes.they need to report and ignore this piece of garbage.only call to tell them they are being reported, not paid.
