I need help with my payday loans. I have 3 online payday loans and an installment loan. The online payday loans are from Everest, National Payday and American Web Loan. The installment loan is from Plain Green. I live in Michigan.


Everest Cash Advance $100 paid $125
National Payday $400 paid $100
Plain Green $1800 paid $1405.44
American Web Loan $500 paid $0

As ohiogal mentioned, follow the advice in her link, revoke any ACH access they have as well as wage assignments through those sample letters. At that point, with regard to your lenders, you owe 300 to national payday, 400 to plain green, and 500 to american web loan. Everest Cash Advance owes you 25 dollars. If it were me I'd ask for the refund in the message i send asking for the PIF/revocation but some would just consider it said and done and not request the 25 dollar refund. That's up to you.

Has anyone had success with getting Plain Green and American Web Loan off their back? I have a balance with both, but plan on making payment arrangments.

Does it matter that Plain Green is an installment loan and not a typical payday lender? I'm trying to find the in Michigan's law about lenders being licensed in my state. I'm having trouble finding anything that states that installment loans on the internet, regardless of tribal or not, are illegal in Michigan.

Nope since they are tribal they are illegal. Mention that they are illegal for their tribal status, not for the payday loan status in your email - many of them will try to trick you by saying something like "We appreciate a consumer who researches the laws of the services he/she uses, and you are correct in stating payday loans are illegal in your state. However, we are not a payday loan, and we operate under the sovereign law of the _____ reservation in _____."

American Web Loan is stating the following...

"This loan is made and entered into with you by American Web Loan, Inc., an arm of the tribe, wholly-owned and operating under the authority and laws of the Otoe-Missouria Tribe of Indians. This Agreement is subject solely to the laws and jurisdiction of the Otoe-Missouria Tribe of Indians. By entering into this Agreement, you acknowledge and consent to be bound by all the terms in this Agreement; you consent to the exclusive subject matter and personal jurisdiction of the tribal courts for all disputes arising from this Agreement; and you understand and agree that state laws or regulations do not apply to this Agreement, the interpretation of this Agreement or the enforcement of this Agreement."

Do I just tell them that since I'm not part of their tribe that I'm not bound by their laws?

I'm starting to get calls from Total Recovery Solutions about my loan with Everest Cash Advance. I took out $100 and paid $125, so I shouldn't be in collections. The person I spoke to yesterday told me he'll email me a validation letter. This is what I got:

Client: VIP
Original Creditor: EVEREST CASH ADVANCE
Client Acct #:2175**
Placement Date: 11/26/2012
Balance: $200.50

Dear Tracie,


The above referenced account has been referred to our office for collection of the balance in full. Previous attempts have been made by our client to resolve this debt voluntarily. As of this date, those attempts have not been successful. Therefore, your original agreement with the above mentioned creditor has been revoked.

TRS has been authorized by our client to provide the necessary effort to collect this debt. We recommend that you take advantage of this opportunity to pay the balance in full to prevent further collection activity.

Note: If payment of the balance has already been made, please notify this office at 855-868-2577 to avoid further communications.

This an attempt to collect a debt and any information obtained will be used for that purpose.

Is this considered a debt validation letter or do they have to send something more formal??

I'm now getting calls from National Credit Adjusters and I got a letter in the mail today. It states "This letter is to inform you that National Credit Adjusters, LLC (NCA) has purchased the above referenced account (Everest Cash Advance); we are not collecting for Everest Cash Advance. NCA owns the account you created with Everest Cash Advance and we have a financial investment in it. NCA would like to find a positive resolution to this account and will work with you. As of this date of this letter, you owe $200.50. Unless you notify this office within thirty days after receiving this notice that you dispute the validity of this debt or any portion of it, this office will assume this debt is valid. If you notify this office in writing within thirty days after receiving this notice that the debt or any portion of it is disputed this office will obtain and mail you a copy of the verification of the debt or a copy of the judgment against you."

Can NCA take me to court for a illegal loan? I had a $100 loan with Everest, but paid a total of $170 before I closed my account, etc.

Dear NCA...

I hereby demand you cease and desist any contact with me and anyone associated with in regards to account #____________, original creditor Everest Cash Advance. Everest is an payday loan lender located in Nevis, West Indies and is unlicensed to lend in ANY state in the US. That loan is null and void and I overpaid the principal before learning about the loans pertaining to these predatory lenders. I expect to never hear from you again but if I do, I will be more than happy to pursue you for statutory damages under the FDCPA.

Govern yourself accordingly
