what happens if you get a summons and can not go to court do to a illness can they issue a bench warrant for you?




I think that if you don't go to court, the other party will get a default judgment against you. I don't think a warrant would be issued. However, you should try to avoid a default judgment. Is the illness something that will improve with time? Can you file for a continuance, based on your health, so that you can delay the court date?

Yes, I would definitely worry about getting a default judgment against you. Read some of the stories on this site about other people who've had default judgments against them.
