judgement lawsuit (old credit card) ran out of money

i need to know if i can have a judgment against me dismissed for not being properly served for a lawsuit of a old credit card debt? its a credit card from city bank that i dont remember from 2000 and in 2006 i found out about the lawsuit when i wasnt in my apartment due to a fire but they had my mother's mailing address but i wasnt there i was staying in a shelter didnt trust the shelter for mail. she said that she didnt take the summons so they slid it under her door. this company call resurgence financial brought the account and they frozed my bank account and now i dont know what to do.


yes improper service. file an appeal with your local court and usually, a hearing will be scheduled for you within 1 week. at the hearing you need to provide proof of residency at the time of service was a different location and your liens will be released and funds returned as well as judgment being set aside. this is what you need to request is to have a judgment set aside. then, send the plaintiff attorney a validation request immediately once it is set aside. they will go away.
