judgement reported on my credit

:mad:12 years ago my ex wife made a purchase on my name after a divorce. I disputed the charges with the credit bureau. Asset acceptance still reported on my credit for 8 years pass the sol. When it was finally removed from my report, they filed a judgement against me for the same account. The paper was served to my teenage son going out of the house with his friend. He lost the document. And i found out when i ran my credit report. went to court to check the filing status. And my my 16 year son was listed as my brother. i never had the chance to defend myself cause i was never served. now the total amount has qua triple. i hire a lawyer that didn't give me any result for 6 months. Not even a single copy of any documents or proof of action. What should i do to resolve this matter? thanks

this is bad info all around. For one thing, if your son was handed the papers, then you were properly served according to the letter of the law. Every state allows for service to someone on your behalf over the age of 14 at your residence. TThat means there was nothing to sue over for improper service. Steve, if you are not going to follow our advice and learn what is truth then please stop posting advice to people here altogether.

Second, it is premature to claim that there is nothing that the OP can do. You have no idea what can be done---for example, what is the SOL in the OP's state? What if the CA filed suit outside the SOL? The truth is, you do not know what you are talking about, and you are posting advice to people anyways. This can be very dangerous. You could actually end up costing someone a lot of money like this!

OK, some questions....
1--what state do you live in?
2--when did they actually file the case against you? You can find this by checking with the court clerk's office and reviewing the docket for this case.
3--when was the debt originated?
4--did they file the suit in the county where you live?
