Vacating a Judgement in NC
Date: Tue, 05/19/2009 - 12:10
I just went and filed for and was granted an absolute divorce. While looking for my file the clerk said I had a judgement in my name from Discovercard for over $10k and was accruing interest. I was never served with the paperwork to ever come to court. I think my exwife may have been served but neer told me as it was her inital debt. The card was in my name but she ran up the debt, still my fault I know on that part, but I was personally never served with anything to notify me of any legal action Discover was taking against me so of course Discovercard was issued a judgement against me because I did not show up. The last time I made a payment on this account has been at least 6 years ago. What should I do now to fight this? I have had to suffer the bad credit woes for the last 8 years just waiting on this stuff to come off my credit report. I did make the mistake of trying to repay a few of the debts in 2003 (which I know restarts the 7 year clock all over). Any help would be greatly appreciated.
