Should I send a settlement letter to the attorneys that sued me representing Discover Bank? I already answered the complaint. Do I just wait until I get a response from them?
Please advise.


I'm going through the same situation with Discover. Once you answer the complaint you will get a court date. I would speak to their lawyer first and try to settle before the court date. If you cannot pay the full amount offer a monthly payment plan. They may ask you for proof of hardship. A proposal letter with the amount you can afford to pay, copies of pay stubs and a monthly expense sheet that includes your household income and monthly expenses you have. If you do not speak to them before the court date, you must appear on the court date! In court their lawyer will speak to you can discuss your situation. The lawyer will request a new court date for status to give you time settle with them.
I'm waiting to hear from Discover myself and my next status court date is coming up soon! Has anyone else had a similar experience? What happens next? Help!
