Help! I have been watching these boards and trying to begin the process of getting out of debt and cleaning up my credit report, but now I am in big trouble. I have several online payday loans and 3 store front ones, now the online ones screwed up my bank account so much that they managed to take all my rent money. Our credit is bad, both in low 500's so I know that my bank won't lend me money, but now I have no way to pay my rent and they are threatening to us out. We have two little girls(one with a broken leg) and just moved here in July, so I can't let that happen. Does anybody have any suggestions besides payday loans to help? They are the ones who started this whole mess in the first place, but I don't know what to do anymore! We also still owe on our cars, so I can't even sell one really fast to try and make some money! Is there anywhere to turn or are we just bound to become homeless?


Hi Our, so sorry you're going through this! Fins is right, please check out county and community based agencies in your area to see if not only you can get help with the material things, but many do not know that the Salvation Army offers far more than just donated goods. They can offer other services as well, for instance, tutoring for your children and I believe our Salavation Army offers medical help as well.. so definitely call them if there is one near you. Additionally, there may be legal counsel in your area that may advise you for free.
This is just a thought...I used to work with people who were receiving cash assistance...you may want to talk to your county assistance program as they also may know of services. And let me tell you the case workers there will know their stuff because they have to. They are so knowledgable about where to send you because they encounter so many different people with dire situations like yours. I know all this is overwhelming, but please try to act now as you never know where your contacts will lead you. So, at this point, try your county assistance office AND especially the salvation army. prayers here too!! big time, please keep in touch as we will help you in any way we can.

if you live in california and in los angeles county i can definitely refer you a great public agency that specializes in that field...check the site out NLS-LA.ORG

if you got a 3 day notice to vacate from your landlord, you still have some time. have you looked into getting some kind of gvt assistance? i would definitely be able to answer some of your questions if you live in California....PM me if you do please

A 3 day notice??? I use to be an apartment manager when I lived in KS, and we had to give people 30 days to move. You need to get on line and find the Landlord/Tenant Act for the state you live in. The only way I could do anything less is if they didn't move within the 30 days and then I had to go through the police department to have them serve the 3 day notice.

Have you already been sent a 30-day eviction notice and then served by the sheriff or police? Do some checking because your landlord may not be following the rules.

@nband is right- here you also have to be given a 30 day notice to vacate. Then if they want to evict you- it is a longer process than that.Check out your laws to amke sure what they areoding is legal--this may buy you some more time to get some money.

BTW- have you spoken with the landlord about this? If you ar in good standing with them- maybe they will work something out.

Good luck to you, and you and your family are in my prayers.--also another thought, I didn't think they could kick you out in days if you have children, either- not sure, so check you laws, and talk with your landlord karen

I did some checking and it would appear as though it is on the up and up, so far at least. I have tried talking to them and explaining the situation, the assistant manager is the one who said I had until Monday, the actual manager sat their laughing, even when it made me cry, saying how he has heard all this so many times before. The assistant manager actually "seemed" to care and be trying to help, even told me to take a deep breath, it would all work out, but he couldn't stop laughing, it just made it all that much harder and definately left a taste of dislike in my mouth for him!

I am so sorry you have to go throught this--and then have to have some jerk laughing in the process is too much! How would HE feel if it was him, right? I have to agree with 2nband here. You need to get on line ASAP and research the housing laws for Washington State. In most states, the eviction process is much longer than 3 days or even 30 for that matter. Have you also looked into talking to an attorney at Legal Aid?

Thank you so much, we will take all the prayers we can get! I believe it will as well, I just haven't figured out how! LOL I asked my family and was told they can't help me come up with it either, that I may just have to let them evict us. I think I found more support on this board! You have no idea how much that means to me. I am so glad that I found you guys!

A 3 days notice means nothing..until they evict you, you DO NOT HAVE TO LEAVE. That is not an official paper from the court. You can even go in front of a judge and plea your case and be given additinal time under some circumstances.

If you can not afford an atorney definitely look into legal aid in your area.

I guess I feel a little better on that note, however, if they so much as start the proceedings, my DH will lose his job. I went to pawn shops, sold everything I could think of that was of value and am still $600 short to appease them. I am finally reaching my breaking point, even if I let them evict me, like my family said, which is only a sister and brother, where do we go? I am 5 states away from them, so it's not like I can stay at their houses, plus then my DH will be unemployed and we will have nothing at all. I understand that they probably deal with this a lot, but can't they be a little patient and understanding and not lump us all together and find it so amusing? Sorry, guess I just needed to vent, thank you for listening! ;)

I agree with the others in that it takes at least 30 days on the notice portion then another 15-30 days for the apartment to process it through the courts. You are not officially evicted until a police officer shows up with a court order. I worked at an apartment complex for a while and it generally took us 1.5 months to get someone out and then if you came up with the money they stopped eviction. Now if you are already 30 days late then the 3 day notice might hold some water. They may have already taken the other steps in the process. In my state most apartments give official notice if you are 5 days late on payment which serves as the starting point on the 30 day notice. Then you get the 30 days plus another 10 to get it through the court and get an officer out for eviction.

You need to close your bank account immediately to stop the payday loan companies from taking your money. I would suggest picking up extra work and dealing in cash only until you are caught up on your basic bills. If you have car payments then consider selling the cars and buying a cheap 1-2k car.

i also worked as a leasing agent and the eviction process sometimes can be a long process. in the end, i found out the legal aid is a leasing agent worse enemy. we hated them. in our state, if a tenant goes through all the legals and a writ of possession is issued, the belongings could only be removed if it was a 0 percent chance of rain and then we would have to store the belongings in a dry storage area. a lot of landlords do not know the state code and will try to bluff the tenants, but if the tenants go through legal aid, most of the time things will be settled before going to court.

I agree with everyone here. I have rented for many years and have been told that a 3-day notice is only the start of the process and the clock stops once you come up with the back rent.
The issue that I am concerned with here is that it doesn't sound like the landlord is being very accomodating or flexible. But like everyone here has said, it's not official until the sheriff is actually on the doorstep, so I would NOT leave until that point, if that's what is needed.

also, read your lease. a lot of people do not and check to see if their is a clause involving 3 day notice. When i was a leasing agent, before they signed the lease, i set them down and went over the lease with them, but most people were not listening to me, the only thing they wanted was the keys.

so true, also their payment history can be taken in acccount. when i went to court to collect rent, the judge always sided with the landlord unless the tenant asks for a trial and the landlord will have to prove his case. i have had only 1 tenant try to fight the case, but i knew that he didn't have a leg to stand on. most of the time the tenant went ahead and moved (some did pay up and i took the money) but if their rental history was bad i did not take their money. i did try to bluff some tenants and it worked but i was up all night hoping that they would not fight it. (they didn't) but those were the ones that caused a lot of trouble.
