We own a transport company and we moved 10 vehicles for a customer. Now he is trying to take his money back off the credit card. Can we put a lien on the vehicles we hauled to get our money back? He owes us $8000.


I know that under certain conditions, tow companies can take rights to the vehicle. But generally that is in cases where a vehicle has been towed for illegal parking, etc.

In your case, you voluntarily moved the vehicles in the absence of a security agreement. (Ie he did not agree to give you the title as security for the transaction). To that extent, I don't think you can automatically put a lien on those vehicles.

However, if he reports the charge as "fraudulent" to his credit card and they reverse it, it would be the same as him writing a bad check. It could be considered theft by deception (or obtaining services under false pretensees).
