I have recently received a civil action hearing notice from LVNV Funding who we owe nothing to; they claim they are owed the amount due to them (they bought our debt from Sears) LVNV also shows on our credit report - Sears/Citibank who orginally had our account states on our credit report the account status as: Transferred, closed. $amount written off. two years ago when i lost my job i had contacted all our creditors to ask for help (course i no longer can find that information where i had it written down) however, our mortgage company did help us. You can see that on our credit report too. Should i even try and fight this in civil court? I was going to send them a letter of validation - since i know they do not have it - does it have to come from a lawyer? Should i fight it or just try and settle with them?

If you dont try to fight them in court they will automatically get a judgment against you....they know own your debt ...you do owe them. Whether or not you pay it is up to you....however since they are getting the court system involved, you might want to fight it.
