If you are on a debt management Plan and have been making payments since April, 2007 do you need to list these accts on the bankruptcy chapter 13? Can we just list certain accts that we want in the repayment plan or do we have to list all of them ?


Unfortunately you have to list all items while filing for bankruptcy. There are no exceptions. The office of the United States Trustee maintains the right to investigate any bankruptcy case at any point of time. If you have not included a creditor while filing for BK, they will consider it to be a fraud and they will penalize you with heavy fines and in some cases, order imprisonment. In other words, bankruptcy and debt consolidation program are two ways to eradicate debts. One cannot continue with both the plans at the same time.
