I would however, like to share with you the terms of your loan. You received documents in compliance with Utah state law at the time of your loan fully describing how the finance fees are applied and your three (3) repayment options (these are all available for your review should you require them). Contained therein is a description of how the fees and principal are applied to your loan, as well as the loan renewal process. You agreed to the terms of this agreement via electronic signatures. In addition, you received the following forms (we have all of these within our files):

• Form 2 – Loan Note and Disclosure with your ESignature detailing an itemization of your Annual Percentage Rate (apr), finance charge, amount financed, and Total of Payments.
• Form 2b – Loan Supplement with your ESignature indicating your understanding of your new loan terms, your renewal terms, and default terms.
• Form 3 – ACH Authorization with your ESignature authorizing Payday Yes to credit your account with the loan proceeds as well as debit your account for the repayment of the loans and/or fees to Payday Yes.


On Monday, November 20, 2006, as Call Center Manager for Payday Yes, I was made aware of this issue through an e-mail received and it is our desire to resolve this matter with you.

Settlement Offer:

Even though your contracts clearly show that you agreed to the renewal of your loan, it is our strong desire to resolve this issue with you and, as such, are willing to agree to your request to settle the account in full. Your loan is now marked as paid in full and no further obligation is pending.

I appreciate your willingness to resolve this issue and regret its occurrence.

I just sent them a letter via email yesterday!! I am sooooo excited!! Whoo-hoo the letters do work!! Thanks everyone on this site for your undying knowledge!! Now if I could only get Bank of America to cooperate!


Downingindebt...it's like they just want to rack up on the fees and I don't know what to do about that. I went to the branch where I opened it at and the person I spoke with basically was telling me that customer service (1800 #) has the control to do something! That to me makes no sense. He did try and I know he wanted to help but the people he called were not willing to do anything! I am so disappointed. I can only send letters to the lenders and hope they will stop debiting the account until they decide to close it because of the acct being negative over an extended period of time.

It sounds like they don't care about customer satisfaction and only the bottom line. My bank was completely understanding, stopped my debits by phone immediately and allowed me to wait until the next day to sign the papers. (they actually said I had three days to do this) And they suggested I close and open a new account.

Congradulations on getting it settled. Thats a huge relief. My bank was very good also stopping these debits. I think I would look for another bank after this incident. KYSIDE38

So far Del Prado and Payday Yes have marked my account PIF. Starlight is willing to settle for the remaining principle and so is Cash Today Limited! There is light at the end of the tunnel indeed!! Waiting to hear back from United Cash loans, Rio Resources, B&L Marketing, and Instant Loan.

Hudiva, Three of the ones you are waiting to hear back from belive it or not are one company. United Rio and Instant are all under MTE financial. Like bdouble said be careful with these people. This is one dirty company that runs from place to place. They are saying they are indians and exempt from US law. Keep us posted. KYSIDE38

Response from B&L Marketing

If we do not here from you by 11-30-06 I will assume you have no intentions of honoring this debt, and we will move forward with normal protocol.

Basically they ignored almost everything I addressed in my letter. I'm just going to complain to the AG about them. I received a similar response from MTE talking about I can pay the remaining $300, which is what I have already paid them!!

Go after a refund with Starlight HuDiva. I just got my check in the mail today for $1,184 from them and another member has gotten over $2000.000. At first they tried to settle with us for just the principal, but we pursued it and got back every penny of our fees.

UCL is basically ignoring my letter with that reply. I sent them a reply saying it's obvious that they did not read it so here it is again. I get a reply back in all caps that said we read it now read ours again! I just sent them the letter again and I will keep sending it again, again, and again!! I'm just finishing up my formal complaint to send to the AG's office and the Commissioner of Financial Regulation.

Hudiva, United basically ignores everybody they sent a similar letter to my AG. Except my account was marked paid in full. They should have said paid up to the eyeballs all the interest these people got. KYSIDE38

My first contact with them was November 17th. I had sent them an e-mail with 2 attachments; one was a letter and the other was a spreadsheet showing all the loan activity since inception (2003). They replied and said they couldn't open attachments, and asked that I fax the information. I've since done that twice, and I've since e-mailed them 3 times...absolutely no response whatsoever. In my last e-mail to them this morning, I indicated that if they did not want to respond to me I would get my attorney involved and I would contact the Arkansas Attorney General. Also, in the last two e-mails I had typed the text of the letter and the summary of the loan information right in the body of the e-mail so there was no excuse for not knowing what I've been trying to communicate to them. Who responded to you and let you know you're with the "Special Handling Team"?

I originally started e-mailing them about the same time..November 17. I e-mailed them every day for 3 days until I finally got the following response:

Finally...this morning I have the e-mail from PayDayOK stating "We're sorry you're dissatisfied with our service. We consider your loan paid in full." I had also requested a refund of $2K, but there was no mention of that in their e-mail. How should I proceed to attempt to get at least a portion of what I've overpaid them? Or, should I leave well enough alone with the PIF action. Thanks to all!

Getting a refund from these people is not that easy as it is believed. You may have to kiss that portion of money goodbye and will never see it again unless you intend legal steps in this matter. Take the advice of an attorney and know the estimated costs. If the refund is a big amount, you may go ahead and file a lawsuit.
