Hello i recieved a letter from a bankruptcy lawyer saying that midland funding filed a lawsuit against me to garnish my wages. I cannot afford my check to be garnished. I want to know is there any way that I can contact them before they proceed with the lawsuit and what are my rights?

Have you received summons from the court? Midland funding can garnish your paycheck only after securing a judgment order against you. Anyway, ask them to validate the debt. If you can prove in the court that you don't owe the debt or it has crossed the Statute Of Limitations period, then judge is unlikely to issue a wage garnishment order against you.

One of the ways will be to leave your job. In that case, court will not be garnish your wages. But, that is not at all advisable as you'll have no income at the end of the month. Filing bankruptcy can also help you avoid wage garnishment. However, bankruptcy hurts one's credit score. So, I feel that you should consider it as the last option.

You can obviously talk to the representative of the collection agency and negotiate an alternative repayment plan if you really owe the debt. Try to settle the debt out of court. You can also contact a lawyer and get legal help.
