I was just served last night with papers stating I was being sued by Midland Funding LLC. They purchased my debt in 2007 from a credit card company that filed for bankruptcy in 2003. I have not heard from this debt collector in YEARS. What steps should I take?


The fact that the credit card company went belly up is irrelevant....the debt doesnt go away just because the company does. More than likely the debt was bought in the bankruptcy by some other company as an asset.

What state are you in? When did you pay on it last? With luck the debt is out of SOL and you can use that as your defense when answering the summons. Keep a watch on the case and make sure your show up in court.

Sending a DV after receiving a summons will NOT suffice. The court system is now in the loop and not validating will not stop the court case.
