Midland Funding LLC has garnished or filed a levy against my checking accounts for Double what my original credit card debt was. My Wife and I are both on social security disability and this was the only money in both our accounts. Midland didn't give us written notice before taking this action as is required by our state law, the statute of limitations in our state is 5 years on credit card debt and this is a credit card we defaulted on over 6 years ago, plus the fact that they are not supposed to be able to take our social security income. To me they have broken at least 3 laws, and I can't even find an e-mail address or phone number to contact them to point this out to them, complain about this or anything! What should I do? I already changed our social security checks to be mailed to us instead of direct deposit,(hopefully this will keep our checks on nov. 3rd from disappearing into limbo) but how do I unfreeze my accounts? How do I even contact them?

what state are you in? most states require a judgment to places liens/restraints/levies. if thats the case then it opens up other issues that would effect SOL - but also raises issues of servce since you seem unaware. as far as levies with SSI its often up to the banks to make that determination. often when levies are placed they are done without the knowledge of whats deposited into the accounts. if you can prove they knew the contents of the account then you might have an issue - though if they knew about the contents then you likely would have known they had the account as you would have been the one to supply them with that information.
