This is the craziest thing I've ever experienced in my life:
I received a response to my letter today from Loanpoint Usa (Geneva Roth):

Quote:
Betty,

I received your form letter. To pay your balance in full on the loan you will need to Money gram $182.95 by midnight 6/28/2007. Please contact me so that I may give you the information you will need to complete the Money gram form, my number is enclosed.

Thank you,
Rochelle Porter

MY RESPONSE:

Quote:
Rochelle,

My contract states that I may overnight mail my payment to the payment processing center and that is how I choose to pay my balance. It also states that I must use cashier's check or money order and I choose to use a money order. Also, I have not agreed to pay my balance in full at this time, just to make payments until paid off. Please note that I am trying to make arrangements with you and am willing to pay what I legally owe by the State of Tennessee laws. Also note that Tennessee requires companies that lend to residents of Tennessee to be licensed in Tennessee and the amount you charge for your loan cannot exceed $30.00. Therefore, I will be paying on the $150.00 I currently owe due to my state legal charges as listed below:

Loan Terms:
Maximum Loan Amount: $500
Loan Term: Max: 31 days
Maximum Finance Rate and Fees: the lesser of 15% of the check or $30
Finance Charge for 14-day $100 loan: $17.65
apr for 14-day $100 loan: 459%
Debt Limits:
Maximum Number of Outstanding Loans at One Time: 3 (2 per licensee)
Rollovers Permitted: None (cannot renew or otherwise consolidate)
Cooling-off Period:
Repayment Plan:

Collection Limits:
Collection Fees: One $30 NSF Fee; Court Costs
Criminal Action: Prohibited

Please forward me the payment processing center address so that I may send a payment in to Loanpoint.

Sincerely,
xxxxx

As I stated in the previous email I sent you, you will need to contact me by phone to receive the money gram instructions and information you will need. All contact will be made by phone. Please provide me with your phone number or call me.

My Response Again:

Quote:
Rochelle,

As I stated in my letter to your company all contact should be made by email or US Postal Mail so that I have verification of conversations that we have between the company and myself. I assume that you have actually read the letter?

Thanks,

XXXXX

I would just keep at them. I know it sucks, but you have to stick to your guns with them.

Sometimes it will seem like it goes in circles for months . . . I'm not saying that to discourage you, only to show that sometimes it takes a while. But it can be done. You are 100% in the right here, not them. Show them that you aren't backing down, that you do know your rights, and that you won't give in to them!

Their lawyer just called and left a message with my wife telling her to have me call him to "work things out." I went through the same nonsense trying to stop the ACH withdrawal.I felt like I was emailing a machine. Then when I started filing complaints they got even more difficult. I am going to call this guy just see what his definition of "work things out is."

Bflow, do NOT money gram them any money. No one can legally MAKE you pay via Money Gram, Western Union, etc. They have to be able to give you an address to mail a payment to. You keep telling them that over and over and over again. And, no, do NOT call them. They want to do all transactions over the telephone? Sure they do. That way there is no documentation. If she doesn't respond to your last email with a mailing address - to hell with her. I had Cash Today demand a Money Gram be sent to them in 2 days. Did I send it? No. Am I in jail? No. Do NOT mail them the money. Also, read my post regarding VIOLATION. I was instructed by One Click Cash they only take Money Gram or Western Union payments - no address to mail payment to. Don't freak. But, don't give them the money. And don't call her. They're doing this on purpose. They don't want a paper trail to trace back to them. That's why they want you on the phone.

Thank you, frogpatch! Can you tell these people are really, really starting to tick me off now? It's insane! It's so clear to all of us what they are doing, but yet we have to argue and argue to get our point across to everyone else. They don't have addresses, they send threatening email, they only want money grams, etc.... What the hell? Does this not tip people off that these pdl's are operating illegally???? And they flat out LIE to the BBB and other agencies when contacted. Can no one else see this except the people being taken advantage of? One would think that a "business" that does not comply with state laws, that does not have a physical address, the will only communicate via telephone is just a bit on the shady side. However, we have to bend over backwards to PROVE it to people. It's as clear as glass in my eyes. I don't understand the difficulty with everyone else.

bflow, just to have written documentation - email her back and state that you have NOT been contacted by telephone as she stated. Then tell them AGAIN that all communication is to be via email or USPS. At least this way, you are contridicting them (regarding leaving you messages). I don't like lies in writing from the pdls, so I email and correct them. This way I have my response to their lie in writing.
