hang on a second....your post sounds like you are being sued and you were not ever served a summons for it. Did you have any notice of a lawsuit before a motion for summary judgment? If not, you need to contact the court clerks office IMMEDIATELY and review the docket for this case against you. A motion for summary judgment is only filed once they have already filed a lawsuit against you. If you were never served, you need to file an opposition to motion for summary judgment and state that you were never even served a summons. You can then file a motion to dismiss due to improper service.
