HELP NEEDED - Law Suit dismissed without prejudice - Buying Home

Hello, I was being sued by AMEX (<$3000). My case was dismissed without prejudice on 10/02/2009. I am currently trying to buy a house. I am border line approval for a specific loan (fico is 635). I need to address this AMEX issue before I can get approval for a loan. AMEX shows up on my credit report. I still get mailings from NCO Financial which now apparently handles the case. They want payment in full. I do not want to deal with a 3rd party but with AMEX directly.
I notice in the court records its states -
08/23/2010 8:30 AM DEPT. INDST [FONT=arial][COLOR=#000000]DATE TO SET OSC RE DESTRUCTION OF FILE (DISMISSAL) [/COLOR][/FONT]
I don't really know what the above means? They will destroy file - meaning I can submit to credit reporting agencies for removal?
I need to either settle this account (per my loan officer) or remove it from credit report.
What route should I take? Call AMEX direct and try to arrange a payment plan?

AMEX is under contract with the CA...they will not deal with out
AMEX is under contract with the CA...they will not deal with out. You have to work with the CA.
Dismissed without prejudice means that AMEX is free to file again. This dismissal will not affect the AMEX reporting traceline.
