I'm 69 & have never been late on any credit card or payment due. I was laid off March, 2009 & can't get a job. I retained an attorney to file Ch. 7 as all I have is Social Security & limited IRA. No relatives at all. In Manhattan, NY NY, I've had my rent stabilized apartment (by law) since 1974. A Trustee got an idea about a year ago & decided to monetize rent stabilized leases since nobody ever exempted that. He seized the lease from the tenant's estate, as it is called, & sold it to the owner/landlord who then proceed to evict the tenant and get market rent that would not be stabilized. That tenant has option of purchasing a lease for $60,000, but most people, including me, don't have that kind of disposable income. I am not behind on rent or anything except credit cards I used for cash advances years ago when I was out of work 2001/2002. I couldn't pay the taxes on a debt consolidation which my districts Assembly Member wants to help. In fact, she's already submitted some bill to remedy this, but the wheels of justice run slow. What are my options?. How can I get relief? My only income is Social Security and I have about $127,000 in IRA's. My expenses are higher than my SS and run about $3,000 monthly including SS ($1877). There have been four decisions in a year where people lost their leases that were then sold to the owner/landlord. I can't risk that with Ch. 7. Since I was told that it is not a risk in Ch. 13 because asssets are ot liquidated,
I'd like to know if Ch. 13 could be a viable option.:confused::D
