Judgement

Nelly, in the state of North Carolina I paid a debt in full and the creditor I owed did not change or remove late fees over the limit fees. Can a debt collector get a judgement against you in this case. The credit that was issued to me was for $300.00 and I paid them back $601.00. And when I talked to the bank that issued me the credit card they would never agree that I paid them back double. The bank put on the monthly statement that I made purchases when I didn't.
I only used this card one time. Now I have a collection agency trying to sue me for $2,500 that I don't owe. And according to some invoice the collection agency has sent to me the bank show it as a charge-off. How can the bank write a charge off when they were never owed that amount of money. Now the debt collector is taking me to court to try and get a judgement against me for something I don't owe.
It's been 3 years since this occured. The debt collector is saying I owe them and they're the one taking me to court. What can I do to keep them from getting a judgement against me? I have corresponded with them denying this debt they waited over a year to come with this invoice, and they still want to take me to court. By the law don't they have to respond back within 30 days, and the information they present has to be fact.
It's not fact I have documentation showing that I paid this 601.00 back to them and only owed them $300.00.
Help!!!

There's no law that states they have to respond to a DV in 30 days. If you have documentation that you only owed $300 and paid $601, go to court and show your documentation. Also, why did you pay double what you owed in the first place?
