My mother died last year. My 75 year old step-father received a letter from Northland Group, Inc. claiming to be collecting from Montgomery Ward and offering to settle a $3500 debt for $500. He phoned Northland today and spoke with a very persistent woman who demanded his birthdate (he refused to give the last 4 of his social) and told him "that is close, but not what I have on file" when he gave it. He told her he believed that my mother and father had that account, and asked if he could only pay half of the $500 they offered to settle for. He married my mother in 1973. Whether the debt was hers or not I do not know, nor does he. My sister and I helped him organize after our mother passed and never saw any indication that they owed Wards. Was his phone call an admission that he owes this debt? In Texas what is the collection agencies recourse (property judgment, garnish retirement accounts or bank accounts, ???) He is on a fixed income, and though he doesn't suffer there certainly are no extras. Is there a chance of somehow having this dismissed?


it is out of SOL.you see WARDS closed up shop in either dec 2000,or jan 2001.this is out of SOL for just about every state with a couple of exceptions,but TX isn't one of them.check their CR as SOAPLADY advised.if this JDB is on it then get an attorney and sue this place.if is not then send them an FOAD letter.

understood,but when they close.they close totally so i'm guessing that there was some kind of notice sent as to that and to try and get people to pay the accounts,but after the store closed and the window to pay was shut that was it.how long SOAPLADY do you think either the BK court(because they were in CH11)would take to try and collect,or would they just mark it as a loss.just curious.
