just few days ago i received a notice of hearing. so what should i do.
and how is the SOL calculated, I live in CA so the SOL is 4 year. is it calculated from the last transaction of that original account? I have checked the past statements, the last transaction was back in may 2007, and after may 2007 its all late fees and finance charges and over limit charges from the original creditor.

As far as I know the SOL is calculated from the date of your last payment. If the SOL period has expired, then the creditor/collection agency won???t be able to take any legal action against you. Have you give a reply to the summons? You should present on the court hearing date. Otherwise the court will issue a judgment against you. Once the court issues a judgment against you, then the creditor/collection agency can garnish your wages or place a lien on your property. Jason, it appears from what you wrote, that you last made a transaction in May of 2007. I would assume you made your last payment of any amount in April or May of 2007. You stated Midland sued you last year in 2010. I am left to assume they sued within the SOL given the detail you provided. If I am incorrect in the assumptions I have made, please correct me and/or provide more detail.
