There was a big lawsuit in New York a few years ago when someone tried to get out of paying his credit card bill for just that reason. The federal judge that heard the case ruled that he had to pay the bank. Whether the ruling would go the same way today, since there are new laws on the books that make it illegal to process the payment, is a good question. But if you ran up the debt before the new law, you would probably still have to pay it.
