Problem with AMEX

I have unfortunately fallen behind with my AMEX and had been waiting until the 90 day mark to make payment arrangements. I kept getting emails telling me the last day I had to call them to make arrangements. I called on the last day when I had enough money to take care of things and AMEX said they had already sent my debt off to an agency. Since then, the agency has ran my credit report and is now calling me non stop.

In my conversation, the AMEX agent on the phone acknowledged that I was calling on the last day, but said they had assigned the debt over a week before that. I asked to speak to a decision maker and he said they would call me back within 24-48 hours. No one ever called.

I called within the timelines AMEX gave me and was attempting to make a payment and get on a payment plan. Do I have any opportunity for recourse against AMEX? It doesn't seem right they can assign the debt if I am making payments within the timeline they gave me.

AMEX can assign you to collections at anytime without notice and you have no recourse. You were behind and it was their choice. You will now have to deal with the collection agency handling the account.

Thanks for the reply. Even if they are emailing me, telling me I have until a certain date to call and make payment arrangements and I call within that time period to make attempt to make a payment?

I don't understand why they would give me a timeline and then not honor that timeline.

This happens more frequently with Amex than others. It does not appear from what you shared that you were making payments, but you were calling in to set a payment up. Like Soap said, they have the option of sending your account to outside collection after day one of a payment being missed. It is just not common.

I have seen payments made to Amex to bring an account totally current still get sent out to an agency.

You can still work with the agency Amex sent the debt to in order to establish your payments.

In a situation like yours where you are able to set up payments for the full balance, Amex appears to be okay with paying the collection fees to an agency, that they otherwise would not have needed to.

I had the same situation with them -- seemed like a very short amount of time ==- not the 180 days for charge off and they moved me to collections -- but since then, ive been with collections and then back to amex again -- like a ping pong ball -- so I guess it just depends -
